1. Introduction

Welcome to AsapFoodDelivery ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our food delivery platform, including our website, mobile applications, and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2. Definitions

• "Restaurant" refers to food establishments registered on our Platform to post delivery jobs.
• "Driver" refers to independent delivery personnel who accept and complete delivery jobs.
• "Job" refers to a delivery request posted by a Restaurant on the Platform.
• "User" refers to any person accessing or using the Platform, including Restaurants, Drivers, and Administrators.

3. Platform Services

AsapFoodDelivery provides a free platform that connects Restaurants with Drivers for food delivery services. Our services include:

• Job posting and management tools for Restaurants
• Job browsing and acceptance features for Drivers
• Location-based job matching within a 3.5 mile radius
• Rating and review system
• Real-time job status tracking
• Automated job expiration after 45 minutes

4. Free Platform & Zero Commission

AsapFoodDelivery operates on a zero-commission model:

• We charge 0% commission on delivery fees
• No registration fees or subscription charges
• No hidden costs or platform fees
• Restaurants and Drivers keep 100% of their agreed delivery fees

Payment arrangements between Restaurants and Drivers are made independently. AsapFoodDelivery does not process, hold, or facilitate payments.

5. Registration and Accounts

To use the Platform, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

6. Restaurant Obligations

Restaurants agree to:

• Provide accurate job details including customer information and delivery addresses
• Set fair and reasonable delivery prices
• Respond promptly to driver job acceptances
• Approve or reject driver applications within a reasonable timeframe
• Provide honest and fair ratings for drivers
• Comply with all applicable food safety and business regulations
• Handle all payment arrangements with drivers independently

7. Driver Obligations

Drivers agree to:

• Maintain a valid driver's license and vehicle insurance
• Provide accurate identification and vehicle details
• Only accept jobs they can realistically complete within timeframes
• Deliver food promptly and safely to the designated address
• Maintain professional conduct with restaurants and customers
• Comply with all local traffic and food transport regulations
• Handle all payment arrangements with restaurants independently

8. Job Management and Expiration

• Open jobs are listed for a maximum of 45 minutes
• Expired jobs are automatically closed from the Platform
• Restaurants must approve driver acceptances before job commencement
• Jobs can be cancelled or reassigned at the Restaurant's discretion
• Distance calculations are performed using UK postcode data and the Haversine formula

9. Rating and Review System

Restaurants can rate Drivers on a 5-star scale and display your average.

10. Prohibited Activities

Users must not:

• Use the Platform for illegal activities
• Misrepresent information or identity
• Harass, abuse, or discriminate against other users
• Attempt to manipulate the rating system
• Reverse engineer or compromise Platform security
• Create multiple accounts to circumvent restrictions
• Use automated systems or bots
• Collect user data without consent

11. Intellectual Property

All content, trademarks, and intellectual property on the Platform are owned by AsapFoodDelivery or our licensors. Users may not copy, modify, distribute, or create derivative works without written permission.

12. Limitation of Liability

AsapFoodDelivery provides the Platform "as is" without warranties of any kind. We are not liable for:

• Actions or omissions of Restaurants or Drivers
• Quality, safety, or legality of deliveries
• Technical issues, downtime, or data loss
• Any indirect, incidental, or consequential damages

13. Indemnification

Users agree to indemnify and hold harmless AsapFoodDelivery, its officers, directors, and employees from any claims, damages, or expenses arising from their use of the Platform or violation of these Terms.

14. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Platform, you consent to our data practices as described in the Privacy Policy.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

16. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or other reasonable cause. You may terminate your account by contacting us at admin@asapfooddelivery.co.uk.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
